Limited Warranty Statement & Terms of Sale
Quality Management, Inc. (hereinafter: QMI®) warrants for a period of one (1) year from the date of delivery that the new products specified herein (Packing List on reverse side) are free from defects in material and workmanship.
Except for the foregoing limited warranty, there is no warranty of merchantability, nor any other warranties, express or implied. There is no warranty if the product is abused or misused by Purchaser of used contrary to QMI's® Standard Operating Procedures (SOP's).
QMI's® SOP's are guidelines for some typical applications and are not warranted. QMI's® SOP's do not apply if superceded by governmental regulations or standard methods applicable for Purchaser's application. Purchaser is solely responsible for validating whether QMI's products, and/or guideline SOP's are suitable for Purchaser's application.
REMEDY: All claims must be made within twelve (12) months from the date of delivery of the product and must be communicated in writing sent by United States mail to: Quality Management Incorporated (QMI®), 426 Hayward Avenue North, Oakdale MN 55128, USA. QMI's® telephone number is: 651-501-2337.
By accepting the products specified herein (Packing List on reverse side), Purchaser agrees that any and all claims shall be brought exclusively in state or federal court for the State of Minnesota, United States of America, for any and all matters arising out of the purchase and/or use of QMI® products and procedures.
Upon satisfactory proof of claim, QMI® within a reasonable period of time, either will make necessary repairs, replacements or changes, or, where the foregoing is deemed by QMI® to be impractical, will refund the purchase price upon return of the products. QMI® will not be liable for any other Purchaser contract, including any incidental or consequential damages, costs or expenses.
The foregoing remedy is sole and exclusive, and states the full extent of liability of QMI®.
No other remedy will be allowed, whether in contract or tort.
